President John Dramani Mahama has, in line with Article 146(9) of the 1992 Constitution, dismissed the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo, with immediate effect.

The decision followed the submission of a report by a Committee of Inquiry established under Article 146(6) to investigate a petition filed by Mr. Daniel Ofori, a Ghanaian citizen, seeking her removal.

After reviewing the petition, evidence, and testimonies, the Committee found that the allegations of stated misbehaviour under Article 146(1) had been substantiated and therefore recommended her removal from office.

In accordance with Article 146(9), the President acted on the Committee’s findings and recommendations against Justice Gertrude Torkornoo.

Announcing the decision in a statement on Monday, September 1, 2025, the Presidential Spokesperson and Minister for Government Communications, Felix Kwakye Ofosu, emphasised that the removal was carried out strictly within constitutional provisions. He assured the public that both the petitioner and the Chief Justice were given a full opportunity to present their cases before the Committee.

The Article 146 committee presented the report to Mahama at a brief ceremony at the Presidency on Sunday morning, August 31, 2025, by the Committee’s Chair, Justice Gabriel Pwamang, who said the panel had adhered strictly to constitutional requirements throughout its work.

In all, the panel received nearly 10,000 pages of documentary evidence, with each side represented by four lawyers.
