The High Court, General Jurisdiction 10, presided over by Justice John Eugene Nyante Nyadu, has issued a decisive ruling ordering Emmanuel Nii Ashie-Moore, a well-known politician and Greater Accra Regional Chairman of the governing National Democratic Congress (NDC), to release properties belonging to a Singaporean businessman, Mr. Toh You Kang, no later than September 5, 2025.
In a ruling dated September 4, 2025, the High Court also quashed all criminal proceedings instituted by the Dansoman Circuit Court against Mr. Toh, who, according to his pleadings, had donated more than $1.5 million to the NDC’s campaign and allegedly made additional direct payments to Mr. Ashie Moore in connection with lucrative Electricity Company of Ghana (ECG) contracts valued at several millions of dollars.
Certiorari application succeeds
The judgment followed a certiorari application filed by lawyers from Boyuo@Law, led by Cephas Boyuo, on behalf of the Singaporean businessman. Justice Nyadu ruled that the decision of the Dansoman Circuit Court on May 30, 2025, and subsequent rulings involving Mr. Toh You Kang, were unlawful and therefore quashed.
The Court further prohibited the Dansoman Circuit Court from entertaining any future proceedings against the businessman.
The judge emphasised that the orders were necessary to protect the rights of the foreign investor, who is also pursuing a separate human rights case at the High Court against Mr. Moore.
Human rights suit for $2.8m
In addition to securing the release of his properties, Mr. Toh has filed a human rights action seeking damages of over $2.8 million from Mr. Ashie Moore.
The claim, filed before the High Court, is based on allegations of unlawful arrest, detention, and violations of fundamental rights.
According to court filings, Mr. Toh alleges that Mr. Moore, after failing to secure additional payments from him and his family, orchestrated his arrest with the assistance of the police and other accomplices.
These actions, the businessman contends, amounted to intimidation and extortion.
Adjournment of case to October
The High Court has adjourned the human rights case to October 14, 2025.
At the upcoming hearing, the court is expected to delve into the merits of Mr. Toh’s claims, including the monetary demands he alleges were unlawfully imposed on him by the influential politician.
For now, the ruling of September 4 stands as a significant legal victory for the Singaporean businessman, shielding him from further criminal prosecution at the Circuit Court and restoring his confiscated properties.
The outcome also adds another layer of scrutiny to the relationship between political financing, business interests, and the exercise of power within Ghana’s legal and political landscape.
