Legal battle begins as court hears Serwaa–Daddy Lumba marriage case

The Kumasi High Court 5 has begun hearings to determine the legality of the alleged civil marriage between Ms Akosua Serwaa Fosuh and the late Charles Kojo Fosu, popularly known as Daddy Lumba.

The legal team of the plaintiff, Ms Akosua Serwaa Fosuh, presented a witness statement, various evidence and a power of attorney to the court to allow Mrs Georgina Osei-Bonsu, the sister of the plaintiff, to represent her as the first witness.

The court presided over by Her Ladyship, Dorinda Arthur, admitted all the exhibits, including the power of attorney, which served as evidence to back the claims of the plaintiff.

However, the judge requested the original copies of most documents, such as the marriage certificate, to be presented to the court to replace the photocopies admitted.

Mrs Osei-Bonsu was thereby cross-examined by the legal representatives of the first and second defendants, Abusuapanin Kofi Fosu and Priscilla Ofori (Odo Broni), respectively.

However, due to time constraints, the second defendant’s legal representatives were unable to complete the cross-examination of the plaintiff’s representative.

The court adjourned the hearing to Wednesday, November 19, as planned.

Her Ladyship Arthur said due to the weight of the case, the hearing would be held each day until Friday, November 21, 2025 and judgment pronounced on Monday, November 25, 2025, to allow the deceased’s family to peacefully bury him.

Before the court hearings, the court refused the plaintiff’s injunction application to prevent the final funeral rite of the deceased from taking place on December 13, 2025.

The judgment was passed based on a balance of convenience, which weighed the side that would incur greater losses if the funeral was prevented from happening on the said date.
